Legal Question in Consumer Law in Virginia

Tech support wiped out my hard drive w/o warning!

My husband owns a Dell computer,as a published author he relies on his computer for writing his novels, called Dell support upon encoutering a problem and after a few different suggestions didn't work to restore it to working order they said they'd send a disc to fix the problem. At no time did any tech spec.advise him that loading that disc would erase all of his work for the the last 9 mos( 30000 words of a book)all our family baby photos...everything in it's entirety, gone. They confirmed afterward that there's no way to restore any of it and asked him what kind of compensation he would like. What should he do? His livelihood was erased by the company that's supposed to help him keep his data, he called for help to access his work and was instead advised to load a ''wipe out disc'' without any verbal, written, or otherwise stated warning, disclosure, or disclaimer...Please help soon, they said they'd call back in response to 30k( a dollar per word of novel)number he said in response to 2nd request of a $$amount that would please him. They pressured him to give an amount without making any offers and said they'd have a senior mgr call within the next 36 hrs. I'm sure the calls were recorded.Thanks.
