Legal Question in Credit and Debt Law in Virginia

We are going to trial against HOA for unpaid bill. The amount we are being sued on includes the this year which is not due yet. Can they sue for payments that are not due? Also we made payment since we received the notice,which brought the amount owed to less than than they initial claim. Can we ask them to drop the case?all we now owe is last quarter which is going to be paid this month.
