Legal Question in Criminal Law in Virginia

Assualt & Battery 1,

I had a guest in my home we began drinking- she more than I- she became verbally abusive an screaming obscenities - I could not reason with her. She began slamming my refridgerator door and then she threw a barstool - i demanded she stop at which point she shoved me backwards and asked what the F*** are you going to do about. I defended myself at that point and ended up with a boxers fracture and she had a black eye and swollen lips as well as scratches on her neck - we are both charged with A&B Class1 Mis. if she chooses to not have the charges dismissed do i have a good chance of claiming defense? i was cornered in and she was violent. i had to have surgery to fix my finger and now going thru PT.

Hard to say; ask the criminal defense counsel whom hopefully you've hired by now as to his or her opinion, after more precise and relevant facts have been fully disclosed regarding the incident. (Furthermore, as to whether any criminal charges might be dismissed is not up to the alleged victim, but to the prosecutor's office.)
