Do we change lawyers?

My son was arrested on 7/2/07 and is being held without bail until present, his right for a speedy trial has been wavered; court date was set for 6/25/08 now our attorney has to have surgury and we don't know when he will be able to return to work, meanwhile at accused has been in jail for more than a year and may not be guilty of anything wrong. What should we do. We have paid this lawyer in full and he wants us to just wait. What are our (accused rights) Thank you.

Merely because you've paid the lawyer in full doesn't mean that you cannot request a partial refund of the advanced fee or retainer which you've paid him and hire someone else for your son's defense if this lawyer for whatever reason is not performing in a manner that meets your son's expectations.

The lawyer works at the pleasure of and for the satisfaction of the client(your son in this case) and not the other way around.
