Legal Question in Criminal Law in Virginia

Two men are pulled over on suspicion of dwi.the police officer finds a bag of crack cocaine in the driver/ owners door along with scales and a can under drivers seat.no one claims the drugs so the officer charges both men with possesion of a controlled substance.the driver/ owner of all gets indited by the grand jury.what should happen to the passenger on the possesion of a controlled substance charge?

I can't say with any certainty as to what "should happen" to the charge

against the passenger based upon these few facts other than it's possible

that this charge could be dismissed before the other defendant pleads guilty

or goes to trial.
