underage purchase or possession by person less than 21

My 18 year old son was arrested and held for 8 hours in ''drunk tank''. He was arrested in a dorm room, no breathalyzer was given but a field Sobriety was. Charges are Class 1 Misdemeanor ''purchase or Possession by person less than 21''. How big a deal is this? Is a Lawyer required?

A Class 1 misdemeanor is not necessarily a "small deal" these days, and if you can afford to hire a lawyer to represent your son to minimize the possible adverse consequences from this incident, all the better.

If your son is a first time offender, he may qualify

for a kind of deferred disposition under Va. Code Sec. 4.1-305(F) which could leave him without a formal record of conviction for this offense if he successfully completes all of the conditions of his probation.
