Legal Question in Family Law in Virginia

what do i do about a bias judge

I went to court with a bad lawyer and end up getting a better one that fought for my rights the best he could he filed the papers that my first lawyer did'nt and the judge did'nt let him get a word in my lawer tried to get the payments reduced to a descents payment my first lawyer did not say a thing when i told him that i did not make what they were asking even if i gave her my whole check every week I still would not make that amount and when my new lawyer told the judge this and even tried to show my pay stud his reply was ''I Don't care and I will not change a thing''. so short of getting another job making the same amount I will not be able to pay those payments let alone pay for my bills. My lawyer said that he did not know what else to do except for me to pay all that I could and maybe that will be enough. To prove that I was trying. I judge said that If I did not pay all that He said that he would put me in jail I asked him how was I going to pay what I did not have and that they use a old pay stub with over time on it from when I went to other states but I also brought a statement from my job stating that they were cutting back on over time and that we would be lucky if we got any. please tell me what I can do? Thank you.

Assuming that your most recent support hearing took place in the Juvenile & Domestic Relations District Court, you would have from its date of entry, 10 days to appeal the decision which you disagree with to the circuit court.

Have you done so and, if not, why not?

The easy answer is to hire the best lawyer you can and appeal the lower court judge. If the case you referred to is a Circuit Court, then you've done all you can. I'm serious about hiring a lawyer who the Judge respects. Makes all the difference.

Presentation of the change of your circumstances and a convincing legal argument to the Judge is what wins support cases.

Good luck.
