Can I change my daughter's last name?

When my daughter was born I gave her her father's last name thinking we would be getting married soon after. We did not marry and now I am wondering if I can legally change her last name to mine or at least add my last name to her current one using a hyphen? What if her father will not consent to this? Do I have to tell him that I am changing it?

You can probably secure a preprinted notice and

motion form from your local circuit court clerk's office or possibly download one from an internet website that would be acceptable to file for a name change.(The clerk will be able to advise you whether the form you plan to use can be submitted in that particular court.) If the father never formally acknowledged paternity of the child and

never paid support, there would be no requirement that he receive notice of or consent to this action.

An attorney could also prepare and file the

necessary paperwork for you as well as advise you on the particular legal issues that may apply specifically to your case, probably for around $250.00-$300.00.
