Legal Question in Family Law in Virginia

Distribution

My exhusband is in arears for the very last payment due me according to an agreement we both signed that was certified by the J&D court in Lynchburg, Va. I have the paperwork to file a ''Show Cause.'' However, I now live in Calif. and I don't know how to go about this if I cannot physically appear in the Court in Virginia. The cost to get there would exceed the amount of monies due me. However, I am not yet employed in CA. and this is now becoming a hardship. I would appreciate your advice.

Re: Distribution

Proceed with the Show Cause action in the Virginia Court. Ask the court to enter a judgment for all amounts owed by your ex and that he be ordered to pay via certified check or money order

the amount of the judgment. You may need to provide the court with a certified statement of the arrears either from DCSE (Division of Child Support Enforcement) or a notarized statement from yourself, if he's been paying you directly.

The clerk of the court will advise you as to exactly what evidence must be provided in order for you to obtain a judgment for the arrears.

Re: Distribution

Contact the child support division of the district of attorney in the county in which you live. The district of attorney should contact the VA equivalent to collect the child support that is due. There should be no charge to you.
