Legal Question in Family Law in Virginia

My ex has went into a jealous rage. After 6 years it was time to call it over. Now I am being served with emergency custody papers 2 days prior. I know she has convicted drug felons around the kids and she herself is in a rehab program using methadone daily. She claims to be leaving by the 1st and has yet to find a job, house or vehicle to provide for the children. Can this help to prove her unfit ?
