Leaving and taking son

My son wants to leave his girlfriend and take his 3 yr old son with him. He has filed the custody paperwork with the courts. She has three other children that she does not have custody of. She has no license or job and no intention of getting either. Any consequences to him taking this action?

As long as there is no current court order which would prohibit your son from taking this particular

action, he is free to do so until there is(and which is not a recommendation that this is something which he should necessarily do).
