Yes, it would seem so (assuming that the children that you leave behind are not themselves in danger), but you would, nevertheless, be well advised to seek the counsel of an attorney who is appropriately experienced and knowledgeable with respect to the Commonwealth's domestic relations laws, if at all possible, and who should be able to further advise you as to how Virginia law may specifically apply to your particular domestic situation.
