Legal Question in Family Law in Virginia

Cannot pay child support

I am under a court order to pay child support. However, I lost my job three months ago and have not been able to find another one. I have been paying the child support by borrowing money. Do I need to go to court to reduce my child support? What can I do if I am unable to pay in the meantime until the judge makes a decision to reduce support? It might take some time to get a decision.

Re: Cannot pay child support

It would be prudent to file a petition for modification of support; the judge hearing the matter could, if he or she sees fit, make the modification effective as of the time of filing.

If it is truly impossible for you to continue making the previously ordered payments during the time the petition is pending, it is unlikely you would be found in contempt of court for noy paying.

BUT, you really should seek legal representation in this matter.

Re: Cannot pay child support

Better file a motion ASAP with the court to reduce the amount of your child support.
