What are my rights

Husband left and moved in with another woman after 8 yrs. Has given me and his 6 yr. old dtr. 30 days to get out of his house. I have no where to go, I'm a full time student with no income, with the exception of $70 a week for the child. He agreed to pay me $150 spousal support but hasn't done so. I've been borrowing money from my family to survive. Waht are my rights?

Why is it only his house after eight years of marriage? You may have a valid marital claim to the property and, therefore, unless a court orders otherwise, an absolute right to continue to reside there.

It may be that you should now be filing a complaint for temporary support(pendente lite)

for yourself as well as your child and to settle the issue as to your right to stay in the house.

An attorney in your area who is knowledgeable regarding family law matters should be able to advise you on this as well as related matters.
