Now that she's 18

My daughter is now currently living with her father due to colledge location. She is 18. Now my ex has filed for full custody and child support, can he do that now that she's 18? Thank you very much for your response to this question.

Re: Now that she's 18

The duty to pay child support on the part of a parent expires upon his or her child becoming age 18 in the Commonwealth unless there has been a prior agreement incoporated into a final decree of divorce which more or less includes language such as "the parties agree that (named parent) shall pay for the support and maintenance of (named child) until (named child)becomes age 22 or finishes college, whichever occurs first".
