Types of Guardianship

Sibling has life-threatening condition and an underage child. My sibling has had several instances of long-term hospitalization and recovery and is very resistant to allowing some type of guardianship arrangement in the event of her frequent hospitalizations or death. Instances have occurred in which decisions for the child had to be made without my siblings input and I was extremely worried I could not get cooperation from his daycare, doctors, etc because I was not his parent.

Is there a type of guardianship my spouse and I can be awarded without terminating her current paternal rights, or should a system be set up if she is too ill to care for her child/or death?

There's a booklet which describes guardianship

in Virginia which may be available at the clerk's office (civil division)of the Juvenile & Domestic Relations District court in your area or at your local library which you may find of assistance.

This is not the type of problem you should be trying to deal with via the internet. You need to consult an attorney in your region who is competent and knowledgeable in this area of the law.
