Legal Question in Family Law in Virginia

My wife and I have been seperated for 4 years no paperwork was ever signed and we have a 11 yearold daughter together that lives with me.My wife passed qway this mornig at her residence and am wondering if I have any legal rights to her possesions so that I could sell them for the money for my daughter's future . There is no will and her sister was only named medical power of attorney

If you were still married to your wife at the time of her demise

and there was no will, then you should stand to inherit

her property under Va, Code Sec. 64.1-1 which describes

the course of inheritance for the heirs of those who die in the

Commonwealth intestate (without a will).
