Legal Question in Civil Litigation in Virginia

stolen credit report

When I signed a lease for an apt. with friends the property manager gave the lease and credit reports to the other tenant. When I asked her for my credit report she refused to give it to me. I'm very worried that because of the information contained on the form like my social security number that she may ruin my credit or use my information. Is there any legal action I can take against her to make sure this doesn't happen? Also, is there any legal action I can take against the rental company for placing my personal information into the hands of someone else?

Re: stolen credit report

If your lease is under the Virginia residential Landlord Tenant Act(VRLTA), there is a provision governing the confidentiality of tenant records found at Va. Code Sec. 55-248.9:1. There are six general exceptions listed where the landlord is entitled to release confidential tenant information(none of which would appear to apply to your situation.)

However, there is no apparent penalty provided for a landlord who violates this provision and unless you can show actual damages which have specifically resulted from what is apparently an oversight(negligence)on the part of the landlord, I would have to answer in the negative with respect to your two questions.
