Legal Question in Landlord & Tenant Law in Virginia

If the check bounced is the lease valid?

Tenant signed lease with 8/7/06 start date. The security deposit bounced on 8/16, and there's been no payment of the Aug. per diem rent. Do we have a valid lease?

Re: If the check bounced is the lease valid?

Tenant is in default of the lease. You, or an attorney, could send default notice in accordance with the lease. Or, the lease may not be valid as a result of tenant's actions--either way, you could commence proceedings to have tenant removed. It is doubtful tenant will do so cooperatively. You may wish to have an attorney review the lease and facts.
