Legal Question in Landlord & Tenant Law in Virginia

Foreclosure & Landlord Chapter 7

We were just notified that our house is in foreclosure by the bank that has the loan, we were given 21 day to vacate the property, when we contact our landlord she stated that she had just filed for Chap 7 while divorsing her husband and there is nothing we can do to try to get any of our money back, my question is, if we re-signed into our lease after her Chap 7 was finalized is it true we do not have any legal recourse against her?

Re: Foreclosure & Landlord Chapter 7

Would seem to depend upon whether you were listed as a creditor and your rent and any security deposits connected with the lease were included in the bankruptcy estate.(If your landlord just filed for a Chapter 7 liquidation, it's highly unlikely that this bankruptcy filing would have already been finalized.)
