Legal Question in Landlord & Tenant Law in Virginia

Landlord Turned Water Off

I live in a mobile home park I have 3 children. My landlord sent some men to my home without any prior notice to check if my toilet was running. I did not let them in the next day they turned my water off and said they have to get a plumber to see if my pipes are damaged and causing the septic tank problems mean while I have a leaking hot water tank and it's been leaking for a long time but now they claim that it will burn their pump out and are refusing to give me running water until they get a plumber out their. I have children isn't this against the law? It is not an emergency situation because they knew that my hot water tank was leaking and I was the one that told them about it.

Tell your landlord that unless your running water is immediately turned back on that you will call the local health department and any other agencies which may be necessary to assist you with this matter.

Re: Landlord Turned Water Off

Dear Tenant,

In response to your question, a landlord usually must give advance notice of access to the rental unit. However, in an emergency they are allowed immediate access.

In this situation, that may have been the case. At issue is the septic system and that is a matter of public health.

As for your leaking water heater, you should put in writing a request to repair that. Since that too is an emergency the landlord has 48 hours to repair the problem.

There may be other issues I can assist you with, but I would need to speak with you to obtain more information.

Our telephone number is 703-777-7319. Thank you for your question.
