Legal Question in Medical Malpractice in Virginia

Adcice needed on medical malpractice

My wife had an labendectomy? (back surgery) to relieve a pinched nerve. She got an staph ifection in the OR. She needed 2 additional operations to get rid of the infection , each 20 days apart. After the 3rd operation the third operation the diagnosis was that she still needs another operation to remove scar tissue caused by the staph. A second opinion from another Dr. contradicted the first. The original Dr. said maybe 60% of some relief. He has toldher she cannot return to the work. Workers Comp has paid all medical costs. Could (or should) we pursue any legal recourse from the hospital and/or Doctor for almost a year of needless pain and suffering and also for future lost earnings when Workers comp Plays out?(Sorry this was so long)Thanks in advance.
