Legal Question in Medical Malpractice in Virginia

Herpes

My son is in college in N C and the girl he has been dating he slept with. She claimed she had never slept with any other guy. He now has Herpes and has never slept with anyone else. Does he or I have any legal recourse against this young lady?

Obviously he did not get it from a toilet seat!!!!

Legal recourse, you ask? For yourself, since the

alleged injury does not involve your body, the answer is clearly no. As for your son, under the circumstances which you've described, I would find it highly doubtful.

I don't know what the law is in NC, but if you think herpes is a b****, try proving in a NC court of law 1) that she gave it to your son 2) without telling him and that 3) he did not already have it; and then 4) try collecting damages from her. Your son would have to come up with serious money up front for an attorney and for an expert witness (a physician) and then it would be he said, she said.
