Legal Question in Personal Injury in Virginia

injury

my daughter was hit by a car while on her bike. It was done on private property. I understand that VA has a 100% liability if there is only a 99% chance that the gentleman that hit my daughter there is nothing we can do. (supposedly) My question is how can we get his insurance to pay (they are saying because he did not get charged) so all of her bills are paid as well as getting some pain and suffering out of this.

It doesnt matter that it occurred on private property or that the driver of the car was not charged. Va is a contributory negligence state but that might not apply--depending on the age of your daughter. You need to talk to a lawyer.
