Wedding photographer defaults on agreement

My brother was married this past March and I knew a guy I went to high school with who is an up and coming photographer so I referred him. He came on time to rehearsals and the wedding, took great photos, posted them as a work in progress on a web site, even posted photos of the album they would go into...and no one has heard from him now in 3 months. We've tried calling, contacting him online, and visiting his place of employment. We don't want to harass him, but we want the photos and a percentage of the money back at a minimum. Because the photographer lives in VA and we live in NC is it best to send a certified letter or to proceed directly to small claims court and have him served?

Small claims court in Virginia (unless he works in N. Carolina) after you've sent a formal written demand notice.
