Legal Question in Product Liability in Virginia

Warranty of Product

I was wondering who should be liable to replace a product?

1)Original Manufacture of product supplied to

2)Company who places their name (label on Product) or

3)Store who sells the product

Purchased a soft-sided waterbed mattress ($740.00)with full warranty up to five years. Currently in the second year of the warranty. Contacted store who I purchased mattress from for warranty determination. Was informed that the original manufacture of the mattress has since gone out of buisness and that company who places thier label on the mattress is willing to sell me a new one at cost but not replace it. Must purchase complete set since mattress is now a different size with dimension changes ($450.00).

You need to check the warranty to see what party is named as responsible. If it is the defunct manufacturer, you should check to see if the store or the "Company who places their name (label on Product)" made any representations concerning the sale. Check the receipt and any other written materials. Good luck.
