Legal Question in Real Estate Law in Virginia

I have ground floor condo. Condo upstairs had developed water leaky and damaged my bathroom ceiling. Repair cost was $4K at present paid by HOA.Cost is very excessive as repairs was done by HOA)

Leak was due bathroom pipe in common space in the wall in upstairs condo.

HOA wants money from Upstairs condo owner who does not want to pay and insists it is HOA problem. He wants to take legal action.

I do not have Insurance and Insurance CO. for guy above refuses to pay him cost of repairs as it is due to old piping system.

I am afraid HOA will ask for half expanse from me? Is it fair?

Until you are specifically asked to pay half of this expense, your fear lies in

the area of the law that might be termed uncognizable, i.e., merely speculative,

and therefore must await your receipt (if ever) of a concrete demand for such payment before a reasonable response need be contemplated.
