Legal Question in Real Estate Law in Virginia

Hi,

I have a commercial real estate lease that I took over legally from a previous tenant. That tenant signed over "all of the right, title and interest of Assignor in and to the Lease." On a document given to us by the landlord. The landlord signed off on this document.

I paid the tenant the security deposit when we signed this... I have a seperate document for that between me and the tenant.

Now the landlord is saying that based on the original lease which shows the original tenant made the security deposit, that they are going to give the security deposit back to them.

I told them that that's not what the assignment of lease that they have signed by both of us states and she says I'm wrong.

The lease is dated Jan 2003 and the assignment is dated Sept 2004.

Am I right. (I think I am)

Without reviewing this assignment of the lease, how could anyone in this

particular forum say for sure?
