Legal Question in Real Estate Law in Virginia

if i leave do i lose

we have been married 18 1/2 yrs, owe 130,000 on a 350,000 house, and another rental. if i pack up and move do i lose it all, desertion or something. someone told that happened to a friend in north carolina. just cheking as to what i should do.

You would be well advised to consult with a Virginia attorney who is knowledgeable regarding

the law governing domestic relations in the Commonwealth. This person will be able to advise you as to how under your particular circumstances

you can avoid being charged with desertion/abandonment and how your share of the marital assets can be best preserved and safeguarded for you in the event there is a final dissolution of the marriage.

Packing up and leave? Not advisable. The answer to your question is not so simple. I would need to take a look at your entire situation: children, property (who purchased what and when), respective incomes, reason for leaving and so forth. Desertion and abandonment certainly could come into play... so I would for sure meet with an attorney before doing anything.
