Legal Question in Real Estate Law in Virginia

Life estate deed

How do I go about getting my mother-in-law's name off of the deed. The life estate is null & void as she has not resided in the home for well over a year.

Re: Life estate deed

You will most likely need to hire an attorney to fle an action in the local circuit court to secure an order from the court allowing for the removal of your mother-in-law's name from the deed based upon the grounds you've suggested.(The foregoing assumes that she would be unwilling to quitclaim her life estate interest voluntarily either to you or to the grantor if the latter is still alive.)
