Legal Question in Real Estate Law in Virginia

Post-Nuptial Agreement: transfer of Real Property

Does the post-nuptial agreement cover the protection of property. My intend is to transfer all property to my wife to protect them but in the edvent of a divorce or death, I still have shares. Transfer all real property to protect my family and still be protected as well? Can I use the forms on your site? Will they be all I need?

Better see a lawyer about your proposal; there may be another instrument or methods available which are more appropriate for your objectives such as a closely held (family) LLC or even, perhaps, a revocable living trust. A lawyer who is knowledgeable in wills, trusts and estates as well as the formation of closely held business entities will be able to advise you once it becomes clearer as to exactly what the objectives are which you hope to achieve and why.
