Legal Question in Real Estate Law in Virginia

rent to own rules

i purchased a home through owner financing. when the paperwork was being signed they asked me to sign a list of rules. Can't have any pets. can't plant any trees etc. Is this legally binding? If I do get a dog can they force me out?

Re: rent to own rules

Your subject heading says "rent to own" but your question says "owner financing."

Is it enforceable? Well it would depend on how the lease is written and how this list of rules was handled. If the contract makes the list part of the contract, then yes. There would have to be something in the contract that refers to the list and makes it part of the contract.

But to the extent that you might NOT actually purchase the house or complete the purchase, they do have an interest in getting a house back in good condition.

They face the risk of you not being able to complete the purchase, and they end up with the house back, but in bad condition.

I don't understand the part about not planting trees, but I think they could probably enforce the list IF the contract is written in a way to make it part of the contract.
