Legal Question in Traffic Law in Virginia

52 in a 35

Received ticket 52 in 35. Road is a route 673. According to va law, routes 600 and above speed limit without posting is 55. There were two 35 signs 3 miles down road, in my opinion not visible considering the area. There was no sign indicating to reduce speed ahead. VDOT is now doing

a review of all signs on the road and admitted that the speed reduction sign should have been posted. County Dept. of Trans. advised that they will also try and get the sign up within the next few days also noted that they may be able to move 35 mph sign to more visible area.

I admitted to the officer that I did not see the posted signs. I advised I have not had a traffic ticket since I was 17, which I am now 42. Can I use the defense that the

reduction of 20mph in speed sign should have been posted to advise the driver of the change. Further, I was approximately .4 tenths of a mile from the first sign until

I reached the officer's location.

Re: 52 in a 35

It would appear that you've put together a credible defense to the traffic infraction with which you've been charged.
