Legal Question in Traffic Law in Virginia

I was cited for going 61 in a 45, under 46.2-875 - is this the proper code I should be cited under or should it be 46.2-870 in Virginia? I'm looking for anything to get out of the ticket.

In reality, makes no difference since the proesecutor can easily amend the charge on the day scheduled for your hearing if such might be required .What matters is what the officer saw and measured in regard to your alleged speed and is willing to testify to under oath, if necessary.

You will not have this case dismissed based upon this particular "technicality "i.e., wrong charge, which apparently you now appear to have in mind (in my opinion).
