Completed Towing Question

My car was towed from my complex's garage this morning at 12:15am. There was a temporary pass in the rear view mirror that expired yesterday (11:59pm).

When I went to pick up my car at the sketchy little temp. building in the middle of nowhere, they told me they couldn't take a check - only cash or credit card. I paid with credit card and went to get my car, only to find that every door was unlocked. Furthermore, the temporary pass previously hanging in my rear view mirror was gone. I can only assume that they broke into my locked car and for whatever reason, took the pass.

I called the company and asked if it was legal to do that. The lady said it was, but she didn't know how or why.

I know I'm probably just upset by what happened this morning, but is there anything about that situation that is legally questionable?

I would say no unless your vehicle was somehow damaged during the period it was in the possession of the tow company.

(There is also a statutory cap on towing fees in each Virginia jurisdiction which should not exceed approximately $90.00.)
