Legal Question in Traffic Law in Virginia

speeding and suspended license

my son was caught speeding in virginia and the cop who pulled him over told him his maryland license was suspended. he has only had it for a year and his driving record is clean. apparently the computer was not working right. my son not knowing tried to hide it from me but he didn't show up for court but he called and made payment arrangements with the court. my problem is they are charging him 150 for driving on a suspended license even though it was not. i have a copy of his driving record as proof. we tried calling the roanoake court house and the clerk told me as far as she was concerned he agreed to pay so it didn't really matter that his drivers license is valid. i know he has to pay the speeding ticket but how do i get the suspended license charge dropped. he is a college student and isn't to bright. what are his options at this point. there has got to be something that we can do.

Re: speeding and suspended license

Find out the name of the judge who handled the case and write him or her a letter explaining the situation (copy to prosecutor)with a request that the court schedule a rehearing or analagous proceeding on the matter.(Attach copy of son's Maryland driving record.)
