Legal Question in Wills and Trusts in Virginia

death of sibling without a willl

My brother passed away a year and a half ago in Virginia. I know he had a bank account but did not name a beneficiary. Since I live in another state, is there a way to obtain these funds without returning to Virginia?

Re: death of sibling without a willl

If your brother died intestate(without a will) in the Commonwealth, his estate(including any possible bank accounts) must be probated here. If no relative

is available in Virginia to come forward and file papers with the probate court to be appointed administrator, then you could retain a Virginia attorney to handle it.
