Power of Attorney

My Father was in a Nursing Home and suffered from deminture. He died in May 2005. My brother was his poa and executor of his estate. My brother had access to the will before my Fathers death. The will was viewed in Feb 2006. My Father stated that his real and personal property be divided equally among his wife and 3 children. It was determined that in Oct 2004 $33k of CD's were distributed in $11k increments by my brother to relatives not listed in the will and only to him and his family and my sister and her family members. Now I have learned that the real estate is recorded only in the names of my Mother(Life Estate), My brother and My sister. What recourse do I have regarding the distribution of funds prior to my Father's death and the real estate?

I would suggest that you consult a local attorney who handles probate maters in the area where the will was probated for him or her to review the relevant facts regarding the situation described as well as the will itself and any other relevant documents, and who then should be able to advise you

accordingly as to what recourse might reasonably be available to you(if any).
