Legal Question in Wills and Trusts in Virginia

reasonable trustee fess

Lawyer has been trustee for over 20 years @$4000 a year paid in fees. Trustee suddenly takes it upon himself to increase his fees to over $12,000 a year without prior notice and in the middle of a fiscal year. Other beneficiaries are not being charged more. Will states trustee may take ''reasonable fees''. Other trustees in same area charge $175-350 an hour, this trustee signs less than 10 checks a month. Is this fee increase legal? Can I get an injuction against him? He's been doing things like this for years, but I don't have the money to sue him (will stipulates he may use the funds to defend himself). Trustee is openly hostile and vindictive, can't help but feel this is a personal attack. Please help!

Good Morning,

To properly answer this question, it would be best to review the will/trust provisions.

As a beneficiary of the trust, you should have the right to demand an accounting of the trustee's time allegedly spent on trust matters.

If the trustee refuses your request for such

or provides an accounting that is less than satisfactory, you would need to file a motion with the appropriate Florida court to review the matter.
