Step-parent refuses to probate will

What is the rights of an adult child, when a parent dies inestate, and the step-mother refueses to let biological child review the will or probate it?

If the parent died intestate, there would be no will, but the child could apply to the local probate court for letters of administration to be appointed administrator of the parent's estate in the event that the decedent's surviving spouse declined to do so.
