Legal Question in Workers Comp in Virginia

Hurt Twice

I got hurt at work and and they believe I have torn a tendon sheath and have a hairline fracture to my foot, anyway I have been going to the doctor and the ortho doctor and keeping track of the times when left work and came back,(they have me on light duty, drugged up so I can barely function or stay awake but atleast I am not missing any time, huh)and I turned it in only to find out that since I didnt miss any time after the accident( because they wouldnt let me, the doctor said he was told to put me on light duty)that I dont get reimbursed for the time I missed work to be at the doctors, I got hurt at work due to unsafe work conditions( I know this because I was in charge of writing up unsafe stuff and people and this was supposed to be fixed almost 10 months ago, and myself and coworkers who work around the cracks in the floor have been complaining about it)I dont feel I should have to eat the cost of lost wages to go to the doctors when I got hurt at work, w comp or my work should have to pay when I clock in and out for the doctors

Re: Hurt Twice

You give no indication whether you've actually filed a claim with the Workers' Compensation Commission. If you have not, this should be your first priority.

Furthermore, you should be fully compensated by your employer's insurance carrier for any wages which you have lost due to your visits to the doctor for treatment of your injury.

Re: Hurt Twice

You should file a claim for benefits with the Virginia Workers Compensation Commission. Get an itemized list of your doctor's appointments and have them signed by the doctor and file a claim for the lost time. Call 1-804-367-8615 and ask for Claims to obtain the claim form. You should note a claim has to be filed within 2 years of your accident or it will probably be barred.
