Car Title

We sold our son a car and he is deliquent on the payments. However, when we did the title transfer, the car was put in his name, even though we asked that we be put on the title as the lien holder. We wanted it in his name for insurance purposes. Can we reposes the car? How do we get the title back in our name?

You can sue him for the value of the car or the posessory interest. Once you win a judgment you can exercise post judgment remedies such as repossession - unless you have a written contract with your son that allows pre judgment remedies.

If you want the car back you have to sue him in superior court. Hope this helps. Elizabeth Powell
