Bid Proposal

Unsigned proposal and fee (%of the proposed bid)was requested when a bid was turned in. Calculated amounts for wages and other required items,on the proposed bid, added incorrectly (300.00 short), brought to our attention, we requested an addendum, but was denied. The fee requested was for the % of our proposal(the correct amount of the total bid) and it was accepted (but not cashed yet).

Generally, a mistake in a proposal that is evident on its face (such as an addition error were all of the extensions are correct but the total is wrong) cannot be accepted by the owner. Because the error is apparent, the proposal is not valid. The owner can either accept the proposal based upon the correct number, or it can reject it. It cannot "snap up" a bid that is clearly in error.

Generally, an offer may be withdrawn at any time prior to acceptance. Holding the check is not acceptance. A person must give written notice that a proposal is withdrawn to prevent acceptance.
