This is a hypothetical....
Zimmerman, a manufacturer of sport uniforms, hired Kelly to secure sales in a four state geographic area. Kelly was told for his service he would receive a salary of $50,000 and be provided the use of a company car. The understanding between Kelly and Zimmerman assumed that the agreement would be enforceable for one year unless terminated by either party. The agreement also inserted a promise by Kelly that he would not seek employment for ten years anywhere in the United States where Zimmerman had competitors. During the year and while driving the company car, Kelly caused an injury to Smith totaling the car. (it was learned that Kelly had been driving intoxicated) Smith brought a lawsuit against Zimmerman. Zimmerman fired Kelly.
