Legal Question in Credit and Debt Law in Washington

statue of limitaions

I was recently called by a collection agency about a debt i had with ascholl i attended in 1992. They stated that I owed a large amount. I tolfd the representitive that I needed some time to investigate, she stated that if I did not make some type of arrangement today then they would start further actions. My wages have been garnessed before so I was afraid of that happening again so I agreed to set up a temporary payment plan for 3 months. If it was fraulant I could stop payment on check. Do I still have any recourse in statue of limitations.

Re: statue of limitaions

Is this a student loan? Is there any history of payments since 1992? Do you still have your loan documents?

If you agreed you have waived any protection afforded you by the statute of limitations. Student loans have strange rules, it would be very odd if you had not had any contact since 1992!

Please contact the State Attorney General to file a complaint, let the AG tell you if this action can proceed.

Always deal with collectors in writing and always demand validation of any debt they say you owe.

You might want to look at budhibbs.com. I wish you all the best with this, but . . . you may have waived the protection to which you are entitled, or alternatively, this may be collectable depending on what you signed.
