Legal Question in Criminal Law in Washington

False police report

My spouse filed a police report alleging breaking of no-contact order with my daughter. I was arrested and was able to prove my innocence four months later. Should I file a complaint for filing a false police report or, maybe, a civil action for malicious prosecution and in which order? I need to get the 25k bond money back.

Re: False police report

Lawsuits are always easier to contemplate, much less file and win. I don't know exactly what you meant by "prove your innocence" but being found not guilty or even a dismissal of a criminal charge does not directly translate into proof of actual innocence. Most lawyers will take this on a hourly basis which could easily eclipse the $25K if it proceeds to trial. If her allegations were found to be completely false, you might have some recouse through the family law courts. Family law judges frown on using the children as pawns.
