Legal Question in Criminal Law in Washington

I was pulled over for a brake light and the officer that stopped us claimed to smell marijuanna and asked to search the car. My boyfriend pulled out 20 grams and a pot pipe from under his seat and said it was his. I wasn't cited for the brake light and they sent him charges in the mail, possession of marijuana under 40 grams and possession of drug paraphernalia. Now he has an up coming court date and I was wondering if he should plead guilty or not guilty?

Any lawyer is probably going to recommend he plead not guilty at that first hearing so he can talk to a lawyer. That arrest, without any more information, sounds like it is probably legitimate and will hold up in court. But there are lots of details we aren't provided yet.

Once he has an attorney, even if he is without a legal defense, it may be possible to negotiate some outcome that keeps him out of jail. But that only becomes possible if he pleads not guilty at the first appearance.
