theft 1

my husband has a warrant for theft 1 and its his first offense and hes been out of state. can he do serious time for this? Or would they maybe just give him probabtion and make him pay the money back?

Depending on the facts and circumstances of the particular case either one is possible. A petty theft that incidently happens to be theft one because of the previously unknown value of the item will likely get probation only. However, if they feel this one count is the tip of the iceberg on a number of criminal acts than they can try to give him serious time for this one case. His lawyer should have some idea of what he's looking at as the prosecutor will have made an initial plea offer. If you need more help contact me directly.
