Family law: Changing a minor child's last name

Can a mother who maintains primary custody of her child hyphenate her child's last name against the wishes of the child's biological father? Can this be done legally? The mother wishes to hyphenate the child's name to include the last name of the child's stepfather of over 4 years and is the same last name of the child's mother and 2 siblings. The child is in school and wants the last name of her stepfather, mother, and siblings, and is heartbroken that her biological father has forced her to use only his last name at school.

Re: Family law: Changing a minor child's last name

A court is not going to order this based on the facts you have provided. I could see a court interpreting an attempt to change the name of child to incorporate the stepfather's name as an attempt at alienation of the child from the father.
