Legal Question in Family Law in Washington

My husband and I would like to move to Texas when his enlistment in the Navy ends in 2014. But my son's father want allow it and has threatened to charge me with kidnapping should I move. We have no formal custody agreement, even though I have agreed to allow him as much access to his son as he would like he chooses to only see his child maybe once every other month, and he will not pay child support. Not allowing us to move is about control, not cocern for his child or even the desire to want to see his child more than a few times a year. But I don't have the money to fight him in court over this. Is there any way that imy family and I can move without getting charged for kidnapping?

You need to file a petition to have a parenting plan established, and as part of that process, seek permission from the cour to move.
